Appeal to the TAR (Regional Administrative Court) – update on Castel Giorgio

On October 14, a first hearing was held at the Lazio TAR re: appeals from the municipalities of Castel Giorgio, Acquapendente, Allerona, Bolsena, Grotte di Castro, Montefiascone, Castel Viscardo and Orvieto, against the pilot geothermal project at Castel Giorgio. The municipalities were all assisted by the lawyer Michele Greco.

The TAR accepted two requests from the municipalities:

  • to set an early date to hear the appeals
  • to deal with these appeals simultaneously with those proposed by the regions of Umbria and Lazio, Italia Nostra and local individuals and businesses. The first appeal from the municipalities, which was introduced in 2015, is to be dealt with together with the four current ones.

Setting a date of January 12, 2021 for the final discussion allowed the municipalities to waive a request for “suspension” which is now, all things considered, superfluous.

At the hearing on January 12, all parties will be able to present themselves together, giving maximum weight to their requests.

The ITW & LKW lawyers went to great lengths to oppose the applicants’ claims, but in vain. All in all, an excellent first result in the long and complex battle to protect the environment and the people, even if the outcome remains uncertain.
